Terms & Conditions For Purchasing

The Airplane Hangar, 37350 E 50th Avenue, Adams County, CO At Public Auction

 

The hangar with transfer of lease is located at 37350 E 50th Avenue, Adams County, Colorado and being offered at public auction on behalf of the United States Bankruptcy Court.  The hangar is located at the Front Range Airport. 

INSPECTION PERIODS-

                Prospective purchasers are highly encouraged to complete a full inspection of the real estate being offered for public auction prior to sale.  The property is available for inspection on February 27th, 2012 and February 29th, 2012 or by appointment.  The real estate will be offered on Thursday, March 1st, 2012 at 1:00PM MST at 1501 W Wesley Avenue in Denver, Colorado.  At this particular public auction, you are welcome to bid in person or by completing the registration activities prior to sale through telephone.

REGISTRATION PROCESS-

                Any parties wishing to participate at the real estate portion of the auction is welcome to preregister for the auction by e-mail, fax, during inspection periods or by registering on the day of the auction.  Immediately after the conclusion of the auction, a sum of ten thousand dollars ($ 10,000.00) will need to be forwarded as a nonrefundable deposit on the real estate.  The deposit can be paid by cash, certified funds, wire transfer, personal or company check with picture identification.  The auction for the real estate begins at 1:00PM.  The auction will be conducted at 1501 W Wesley Avenue in Denver, Colorado.

CONDITION OF REAL ESTATE-

                The property is being offered “as-is” and “where-is” without warranties expressed or implied, no contingencies on purchase.  Neither Dickensheet & Associates, Inc. nor the Trustee, United States Bankruptcy Court make any guarantee or warranty, expressed or implied, as to the quality, kind, character, size, description, environmental condition or fitness of the property available at public auction and will not be held responsible for any advertising discrepancies or inaccuracies.  The utilities will need to be transferred to the successful purchasers name on the date of closing. 

                Prospective purchasers are encouraged to seek from independent sources of bidders choosing expert advice and/or inspections, including legal advice, to buyer’s complete satisfaction concerning any property and the terms of sale prior to the auction.  Please call (303) 934-8322 with any questions.

                In the event that the potential buyer has an questions or material needs regarding exact lot lines, tract boundaries or any easements, as well as the dimensions of land and/or building, the prospective purchaser may choose to have a staked survey by a licensed surveyor prior to bidding at the public auction.

OTHER FEES & EXPENSES:

                The successful purchaser will need to pay any and all past due and current association fees involved with the premises.  Also, the party will be responsible for all past due and current taxes at the premises including 2012 taxes due in 2013. 

CLOSING TIME PERIOD-

                The buyer of the real estate will have a time period of no later than thirty (30) days from the conclusion of the auction to fully close on the property with the balance paid either by wire transfer, cash or certified funds.  In the event that the successful purchaser is not able to close within the allotted time period, the deposit will be forfeited and retained by Trustee as part of the proceeds of the sale.

                If the successful purchaser is unable to fulfill their obligation during the thirty (30) day time and approved by the Trustee, the backup bidder will have the opportunity to purchase the property at the backup bid with the same terms and conditions of sale.

FINANCING-

OTHER TERMS & CONDITIONS-

                The sale shall be subject to all laws, ordinances and governmental regulations (including building and zoning ordinances) affecting the real property and easements, restrictions appearing of record, if any.

Hangar will be transferred by Trustee's Deed.

                All announcements made on auction day take precedence over any distributed material.
